Is it fair for a garage to charge you extra for repair of damage done to your car while being repaired there!?

Lady Laflin: I agree that the shop should charge you for this type of repair, because they would have no way in advance to know that it would break. However, I object to their not explaining potential problems and financial responsibility associated with repairs to you during their estimate. For that reason I would argue a shared reduction in the cost for the repair of stud. Blame the person who estimated your repair, not the mechanic.

Queenie Ruthers: There are times where a nut can seize on a stud and break when removing it. I believe that the mechanic is correct in charging you for the replacement of the stud and labor involved in replacing it.PS if they broke something and it was because of neglect then no they should repair it. Like accidently setting a wrench across the battery posts with a wrench and frying your cars computer. They should replace it at no cost to you....Show more

Hwa Waterford: NO! Absolutely not.paying for their mistakes is ridiculo! us. If it was fair practice to do so they would purposely wreak your car just to fix it and pocket the cash.I wish you luck with trying to get your $ back.btw: try speaking to their manager. Willis Liburd: Mr Wizzard is correct.The estimate was based on the job without anything going wrong.They had no way of knowing the stud might break, or that it might be defective until they attempted to remove the nut. They are not responsible for the weak or defective part you brought to them.Had they dented or scratched the body, ripped the seat, broken a window, dropped the car off the lift or something of that nature then they would be responsible to repair that at no charge....Show more

Tory Clapper: Well,The thing is this happens a lot in some cases with rusty parts.If it was a wheel stud they rarely cost that much, I think you got ripped off.A wheel stud should! only cost you around $50 but in some cases it may be a little! higher.This is a common practice among smaller shops and it gives the whole industry a bad name.The right and honest thing to do would be to give you a revised(supplement) of the estimate or call you and tell you that it would cost you more and how much,So you can see an itemized list of the repair parts and labor.You could try to fight this and dispute the bill but IMO i would just consider it a loss and stay away from that shop.An estimate is just that,it`s an estimated value of the cost of the repair but it can be a vicious tool for the greedy.hope this helps...Show more

Kenneth Queener: I would say that as it was in their care, they are liable. If their insurance doesn't cover it, thats their problem. They elected not to buy insurance that could be attributed to "acts of God", (or natural disasters). Wherever the car is parked (ASDA or elsewhere), a specific disclaimer stating in what circumstances responsibility is declined would have to be posted publicly where! it is easily viewable. However, even in cases where disclaimers are used, the courts may still throw it out (depending on specific circumstances) and find for the claimant. The fact that they are changing their estimates means they have spoken to their lawyers and know that they are liable....Show more
