Curtis Josef: Stop your friend immediately. California is a community property state and anything that a husband or a wife buy while they are married is considered community property!! While it's not likely that the court would award the wife the car if he purchased it after the papers were filed, a savvy enough lawyer could make use of the community property law. Why take that chance?

Shena Etulain: As long as they are married the car is a marital asset and she is entitled to the car as much as he is. It doesn't matter whether they live together or not, as long as they remain married they share all major purchases

Manie Labat: based on my past experiences in tow divorces, here is my answer: my attorney in both cases highly suggested that until the divorce is final that I should refrain from purchasing anything because despite weather or not a divorce has been filed its stil! l "owned" by both and "financed" by both. Also, despite a divo! rce being filed if your friend spent his own $2 and purchased his own lottery ticket weather his wife was in california or europe at the time the ticket is purchased, and he wins the lottery, its shared money by both. has happened an few times in the past 10yrs and all times the divorcing spouse was awarded 1/2.ask your friend 2 contact his attorney 4 his suggestion as 2 buying this car or not since its the atty's job 2 defend anything his client does during the time the divorce is pending in court, weather its a civil court or divorce court....Show more
